Terms of Service

1. Acceptance

By creating an account, purchasing a subscription, or using AndWithYou, you agree to these Terms of Service and acknowledge our Privacy Policy. If you do not agree, do not use the service.

2. Nature of the service

AndWithYou provides organizational tools, educational information, planning support, document-management features, provider discovery, and AI-assisted recommendations for people preparing for or responding to a death or major life transition.

3. No professional advice

AndWithYou is not a law firm, medical provider, funeral establishment, insurance producer, financial adviser, tax adviser, fiduciary, emergency service, or government agency. Information provided through the service is general and informational. It is not a substitute for advice from a qualified professional who understands your circumstances.

4. Emergencies

AndWithYou is not an emergency service. If someone is in immediate danger or needs urgent medical assistance, contact 911 or the appropriate local emergency service.

5. Accounts

To hold an account you must:

• Be at least 18 years old
• Provide accurate information
• Protect your account credentials
• Notify AndWithYou if you suspect unauthorized access to your account
• Have authority to upload or provide information about another person
• Avoid sharing unnecessary Social Security numbers, passwords, full financial credentials, or other highly sensitive information

6. Documents and user content

Users retain ownership of documents and content they upload. Users grant AndWithYou a limited license to host, process, analyze, format, and display that content solely to operate, secure, improve, and support the requested service.

You may not upload content you do not have the authority to use, share, or store.

AI-generated summaries of your documents may contain mistakes. Always check them against the original document and, where the decision matters, against advice from a qualified professional.

7. Acceptable use

You may not use AndWithYou for:

• Illegal activity
• Fraud, impersonation, harassment, or exploitation
• Unauthorized access or security testing
• Uploading malware or other harmful code
• Scraping or bulk extraction without written permission
• Making unlawful eligibility, credit, insurance, employment, housing, or healthcare decisions
• Misrepresenting AI output as verified professional advice
• Violating intellectual-property or privacy rights

8. Providers

Providers displayed on AndWithYou are independent businesses. They are not employees, agents, joint venturers, or representatives of AndWithYou.

AndWithYou does not guarantee provider availability, pricing, licensing status, quality, suitability, outcomes, or regulatory compliance.

You are responsible for independently evaluating any provider and for reviewing final contracts and prices directly with that provider.

9. Fees and subscriptions

Paid plans are governed by our Subscription Terms and our Cancellation and Refund Policy, which form part of these Terms.

Taxes may apply. Payment processing may be handled by a third-party payment processor. Where Stripe is used, AndWithYou does not directly store complete payment-card information.

10. Intellectual property

The AndWithYou platform, branding, design, software, and original content belong to AndWithYou LLC or its licensors. You receive a limited, personal, revocable, non-transferable right to use the service in accordance with these Terms.

11. Suspension and termination

AndWithYou may suspend or terminate access for security threats, unlawful use, nonpayment, fraud, harm to users or providers, or material violations of these Terms.

Where practical, we will give notice and an opportunity to correct the violation before access is removed.

12. Disclaimers

To the extent permitted by law, the service is provided “as is” and “as available”. We do not disclaim any obligation that cannot lawfully be waived, and nothing in these Terms limits rights you have under mandatory consumer law.

13. Limitation of liability

To the maximum extent permitted by law, AndWithYou LLC will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, data, goodwill, or opportunities arising from use of the service. AndWithYou's aggregate liability for claims relating to the service will not exceed the greater of $100 or the amount the user paid to AndWithYou during the 12 months preceding the event giving rise to the claim. These limitations do not apply where prohibited by law.

14. Indemnification

You agree to indemnify AndWithYou for claims resulting from unlawful use of the service, content uploaded without authorization, infringement of third-party rights, or material breach of these Terms.

This does not extend to claims caused by AndWithYou's own unlawful conduct where the law does not permit such indemnity.

15. Governing law

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles. Venue for disputes is the state or federal courts located in Orange County, California, unless consumer protection law gives you the right to bring a claim elsewhere.

16. Changes

If we make a material change to these Terms, we will communicate it and the change will apply prospectively. Prior versions are retained so you can see what applied when.
